The Extension You Can Build Without Asking the Council

Picture this. You want a bigger kitchen. You assume you need planning permission, months of waiting, and a fat council fee. Then you find out you could start almost straight away. No application. No decision. Just your right as a homeowner. That right is called permitted development, and a quick check of eligibility for a permitted development extension tells you whether your project qualifies before you spend anything.

Not every extension gets this shortcut. But a surprising number do. Let’s walk through how it actually works, using the kind of real decisions homeowners face every day.

Step One: Is Your Home Even Eligible?

Before anything else, one question decides everything. Do you live in a house, or a flat?

Permitted development rights only apply to houses. Flats and maisonettes are out, even a ground-floor flat with its own garden. If you own a house, you’re in the game. If you own a flat, you need full planning permission for any extension, full stop.

These rights come from a national law, Schedule 2, Part 1, Class A of the Town and Country Planning General Permitted Development Order 2015. Its the rulebook every council works from. And it sets clear limits on what you can build without asking.

Step Two: How Far Can You Actually Go?

Now the fun part. How much can you build?

For a single storey rear extension, the standard limits are:

Step Three: The Rules People Trip Over

This is where good plans go wrong. Height and coverage catch out more homeowners than anything else.

Your extension cant go higher than 4 meters. If its within 2 metres of a boundary, the eaves cant be taller than your existing house. Double storey rear extensions are stricter again. They max out at 3 metres deep and must sit at least 7 metres from the rear boundary.

Then theres the garden rule. Your extension, plus any sheds or outbuildings, cant cover more than half the land around your original house.
